Definitions
In this Agreement, “the Company” refers to A YOGI (YOGA AND MEDITATION) LIMITED, and “Member” refers to the individual who purchases or utilizes the Company’s services and agrees to these terms and conditions.
A YOGI (YOGA AND MEDITATION) LIMITED, which classes and service cannot be transferred.Any fees paid to the company are non-refundable.
Any deposits paid to the Company, its balance must be settled within 14 days, or it will be treated as forfeiture by customer with no refund.
For any purchased package, plan, or subscription, utilization must start within 14 days of purchase. The validity period of the package, plan, or subscription will start counting from the first day of utilization or within 14 days after the purchase date, whichever is earlier.
The Company reserves the right to change its fees, course schedule, course venue and service providers at its sole discretion at any time.
Member agrees that he/she voluntarily participates in physical exercise and fully understands that there may be risks of injury to him/her on account of these activities. Member agrees that the Company will not perform any evaluation of Member’s physical condition as to whether Member is suitable to perform any exercise activity prior to his/her starting or continuing an exercise. Member further acknowledges that he/she has no physical impairment or ailment preventing him/her from engaging in physical exercise and/or that will be detrimental to his/her health, safety, or physical condition when performing physical exercise. If Member is in doubt, Member should consult his/her physician before undertaking any such activity. Member hereby agrees that the company shall not be liable for any injuries suffered by Member resulting from any activities of the Company participated by member and to waive any and all claims or right he/she might have against the Company (including but not limited to its employees), for any injuries aforesaid resulting from such activities of the Company.
Member agrees to release the Company from any liability for any loss or theft of personal property.
Member agrees to obey all rules and regulations now in force (or as may be amended by the Company from time to time without prior notice) prescribed by the Company for the use of the facilities and services of the Company. The Company reserves the right to revoke or suspend Member’s membership at its sole discretion for continual breach of the following rules (or such other rules as may be amended from time to time) or misconduct:
a) Member must check in at the self-check kiosk before attending classes. Failure to complete the self-check-in may result in a penalty.
b) Member is requested to book classes & service in advance. If a class is full, priority will be given to members who have booked in advance. The Company reserves the right to reject members who have not booked class in advance. Member is requested to follow the guideline.
c) Member is not allowed to attend classes more than 10 minutes late. (The door will be locked up after 10 minutes.)
d) Prohibited activities include (but are not limited to) the following: use of illegal drugs; eating in the studio and changing room; obscene and indecent behavior; smoking; consumption of alcohol; solicitation for profit and distribution of promotion materials within the Company’s premises; photography, videotaping, filming or audio recording without prior permission from the Company.
e) In the event of class cancellations due to natural disasters, the Company will not provide additional measures such as extending the validity period.
f) Damage to the Company’s property shall be compensated by any Member who willfully or negligently causes such damage.
g) Member agrees to conduct himself/herself in a quiet and well-mannered fashion when inside the Company’s premises and shall not cause any disturbance to other members or guests.
Class Cancellation and Schedule Change Policy
a) Members may cancel their class bookings without penalty if the cancellation is made more than 12 hours before the scheduled class start time.
b) Cancellations made within 12 hours prior to the class start time will incur a penalty. The specific penalty varies depending on the package or subscription purchased. Members should consult the purchase page of their respective product for detailed penalty information.
c) No-show occurrences will also incur penalties. The applicable penalty details are available on the purchase page of each product.d) Any changes to class schedules will be notified to Members via email.
e) For classes with fewer than three (3) bookings:
Classes scheduled before 5:00 PM will be cancelled by 10:00 PM the previous day.
Classes scheduled at or after 5:00 PM will be cancelled by 10:00 AM on the same day.
All cancellations under this condition will be communicated to Members via email.
Self-Practice Policy
a) Booking & Cancellation
Reservations open 7 days prior to each session and close 2 hours before the scheduled start time.
Last-minute booking requests made within 2 hours of the class start time must be arranged via:

- In-app MessengerCancellations must be made at least 2 hours in advance. Late cancellations will incur penalties.
Entry to the practice room is allowed starting 10 minutes before the scheduled time. The door remains locked prior to this. If early access is required, members must contact the IMAYOGI Team via WhatsApp in advance.

All equipment and power supply will be automatically shut off, and the door locked 10 minutes after the reserved time ends. The security system will be activated accordingly. To use the facility beyond the reserved time, members must make a new reservation for the desired time slot and notify the IMAYOGI Team via WhatsApp. Unauthorized extended use will result in an automatic penalty charge of HKD 350 per hour, approximately three times the standard walk-in hourly rate. Members are strictly required to adhere to their reserved time slots.
Members must return all props and equipment to their proper places after self-practice.
For safety and maintenance reasons, self-practice of Aerial Yoga is strictly prohibited.
Self-practice is for personal use only. Conducting any unauthorized classes, teaching sessions, or group instruction without prior studio approval is strictly forbidden and will incur a penalty fee of HKD 1,000 per hour.
Members must maintain silence and respect others during self-practice hours. Failure to comply may result in suspension of self-practice privileges.
Package, Subscription Operation
the company offers two types of Regular Packages to suit different practice preferences: the Coin Package and the Unlimited Subscription. Members should refer to the purchase page of each product for detailed information
a) Coin Package
The Coin Package allows Members to purchase a specific number of "coins," each representing a value that can be redeemed for attending designated classes. Different classes require different coin values depending on factors such as class duration or type. Members use these coins to book and attend regular yoga sessions, with each session deducted according to its coin cost. Coins are non-transferable and must be used within their validity period. Unused coins will expire after this period, and fees paid for coins are generally non-refundable. Members should refer to the purchase details for exact coin values and expiration policies.b) Unlimited Subscription
The Unlimited Subscription grants Members access to unlimited regular classes and self-practice sessions during a fixed subscription period. However, there is a daily cap of up to 3 sessions per day, including any combination of regular classes and self-practice. If a Member wishes to participate in more than 3 sessions in a single day, prior approval is required by contacting the IMAYOGI Team via WhatsApp.Failure to notify and obtain approval for attending more than 3 sessions per day may result in automatic charges applied to the Member’s registered card at the standard walk-in (drop-in) rate for each additional session beyond the allowed daily limit, without further notice.
In case of pregnancy, injuries or sickness rendering the Member unfit for exercise, Member needs to submit a doctor’s certificate to apply for suspension of Plan. In such cases, the expiry date of the Plan will be extended to cover the suspension period. The suspension period must be in units of month.
a) If you apply for a medical or pregnancy suspension, you are required to provide a valid medical certificate that contains the date, your name, diagnosis, and the doctor’s advice. the company reserves every right to reject your suspension if such medical certificate is invalid and to charge you HK$250 per month;
b) You may suspend your Agreement for a maximum of twelve (12) months if you are pregnant, or for a maximum of three (3) months in a calendar year for any other reason. The minimum suspension period is one (1) month. You are allowed to suspend your Agreement twice within a calendar year.
c) Suspension fee is non-refundable and non-transferable.
Members may request to terminate their membership by deleting their registered online account ID. Termination is considered effective once the online ID has been deleted. The Company will settle any outstanding fees or obligations accordingly. Any prepaid fees will be handled according to the refund policy. The Company reserves the right to terminate a membership immediately in cases of violation of terms or misconduct by the Member.
Member agrees to pay the corresponding repair fee if the equipment and equipment are damaged due to his/her negligence.
In case of emergency, Members should contact the Management team via WhatsApp or, if appropriate, call emergency services such as 999 directly. Members are responsible for taking immediate action suitable to the situation.
Members are required to remove their shoes while inside the studio. Appropriate attire for yoga and meditation activities should be worn. Members should arrive on time, follow instructor guidance, and respect other participants. Failure to comply with safety or behavioral rules may result in suspension or termination of membership. Members should disclose any physical or health conditions that may affect their participation.
Member agrees that all photos and videos taken at the yoga studio are used for advertising and marketing.
Member agrees to terms & conditions have the same effect once you join new service.
I understand that I will have use of a Day Locker when visiting the company. I agree to return all Day Locker keys prior to leaving the company premises and not keep my belongings in such lockers when not using the company’s facilities.
In case of dispute, the Company reserves the final judgment. This agreement shall be governed by and construed in accordance with the laws of Hong Kong SAR.
Waiver

Acknowledgment and Waiver Agreement
I hereby acknowledge and agree to the following terms before participating in any yoga classes, workshops, or activities offered by A YOGI (YOGA AND MEDITATION) LIMITED (“the Company”):
1. Assumption of Risk and Health Warranty
I acknowledge that yoga involves physical exertion and inherent risks, including but not limited to:
Muscle, joint, or bone injuries.
Aggravation of pre-existing medical conditions such as heart disease, high blood pressure, recent surgery, or pregnancy.
I confirm that I am in good physical condition and have no medical conditions that would prevent my safe participation. I agree to consult a physician before joining any class if I have any health concerns.
2. Release of Liability and Indemnification
I hereby fully release and discharge the Company, its instructors, employees, and affiliates, from any and all claims, damages, or liabilities arising from:
Personal injury, death, or property damage.
Negligence (except gross negligence or willful misconduct as defined under Hong Kong law).
Incorrect instruction or supervision.
I also agree to indemnify and hold harmless the Company for any costs (including legal fees and medical expenses) resulting from my participation or violation of the Company’s policies.
This waiver applies to all current and future classes unless revoked in writing.
3. Emergency Medical Treatment Authorization
In the event of injury or medical emergency, I authorize the Company to seek medical treatment on my behalf at my expense.
4. Photo and Video Release
I grant permission for the Company to use photos and videos of me for promotional and marketing purposes. I understand I may opt out by providing a written notice to the Company.
5. Governing Law and Jurisdiction
This waiver is governed by the laws of Hong Kong SAR, and any disputes shall be resolved exclusively in the courts of Hong Kong.
By checking this box in momence platform, I confirm that I have read, understood, and voluntarily accept all terms of this waiver. My electronic acknowledgment shall have the same legal effect as a handwritten signature.
